The following article gives a summary of decrees by the Council of Ministers and communiqués by the Ministry of Economy regarding prevention of unfair competition in imports, made between 1 July 2017 and 31 July 2017.

Safeguard Measure Imposed on Frameless Glass Mirror Imported from Iran

As a result of a safeguard measure investigation launched and carried out by the Import General Directorate of the Ministry of the Economy, the following implementation periods have been decided as quotas for “Frameless Glass Mirror” under tariff code 7009.91, imported from Iran:

Safeguard Measure Imposed on Polypropylenes Drawn Bidirectional Imports from Iran

As a result of a safeguard measure investigation launched and carried out by the Import General Directorate of the Ministry of the Economy, the following implementation periods have been decided as quotas for “Polypropylenes Drawn Bidirectional” under tariff code 3920.20.21.00.19 imported from Iran:

Amendments to Customs Duties for Iron Wire and Non-alloy Steel Imports

The item descriptions of the iron wire and non-alloy steel under the table in the Annex of the Supplemental Decree to the Decree on Import Regime entered into force by the Council of Ministers’ Decree dated 15.06.2015 and numbered 2015/7749 has been amended and a footnote has been added to the table.

The Amendment Decree numbered 2017/10344 is entered into force by being published in the Official Gazette dated 3 July 2017 numbered 30113. Accordingly, the most recent version is as follows:

Additional Customs Duty Applied to the Umbrellas

Additional customs duty has been applied to the products in list number II, attached to the Import Regime Decision by Council of Ministers Decree number 2017/10345 (“Decree”).

Expiry Review Investigation Launched into Anti-Dumping Duty on Granite Imported from China 

Five companies jointly requested the Import General Directorate of the Ministry to initiate an expiry revision investigation into granite imports from China, classified under tariff codes 6802.23 and 6802.93. The request was made on the grounds that terminating the current anti-dumping duties would lead to continuation and repetition of related damages.

The companies requesting the investigation are:

– Derya Granit ve Mermer San. Dış Tic. Ltd. Şti.

– Granitaş Granit Sanayi ve Pazarlama A.Ş.

– Granitaş Anadolu Granitleri San. ve Tic. A.Ş.

– Granitürk İnşaat Maden Nakliye Turizm Akaryakıt Kömür Gıda San. ve Tic. A.Ş.

– Van Mermer ve Madencilik Sanayi A.Ş.

Accordingly, an investigation was initiated by the Communiqué on Unfair Competition Prevention in Imports numbered 2017/15, published in Official Gazette number 30115 on 5 July 2017.

Expiry Review Investigation Launched into Anti-Dumping Duty on Plywood Imported from China 

On behalf of five companies, the Plywood Producer’s Union requested the Import General Directorate of the Ministry initiate an expiry revision investigation into imports from People’s Republic of China of plywood classified under tariff codes 4412.10, 4412.31, 4412.33, 4412.34 and 4412.39. The request was made on the grounds that terminating the current anti-dumping duties would lead to continuation and repetition of related damages.

The companies requesting the investigation are:

– Aykonsan-Aydın Kontrplak Orman Ürünleri San. Nak. İç ve Dış Tic. Ltd. Şti.

– Bizon Ağaç San. ve Tic. A.Ş.

– Dastaş Demircioğlu Ağaç San. ve Tic. A.Ş.

– Erbaa Kaplama San. ve Tic. Ltd. Şti.

– Taşköprü Tarım Hayvancılık Orman Ürünleri Tekstil Madencilik Tic. ve San. A.Ş.

Anti-Dumping Duty Will Continue For Polyester Flat Yarn Imports From China, India and Malaysia 

The Import General Directorate of the Ministry initiated an interim revision investigation into dumping duties which currently apply to Polyester Flat Yarn imports from China, India and Malaysia, classified under tariff code 5402.47. It decided to continue the existing definitive measures, with certain amendments as below.

The measure entered into effect by being published in Official Gazette number 30122 on 12 July 2017.

The anti-dumping duty will therefore continue as follows:

Anti-dumping Duty Placed on Imports of Concrete Pumps and Concrete-Pumping Vehicles

The Import General Directorate has imposed anti-dumping duties on imports of Concrete Pumps under tariff code 8413.40.00.00.00 and Concrete-pumping Vehicles under tariff code 8705.90.30.00.00. The duty entered into effect on being published in Official Gazette number 30122 on 12 July 2017.

Accordingly, anti-dumping duties now apply as follows:

Procedures and Principles Introduced for Surveillance Applications Regarding Low Density Polyethylene

The Communiqué on Surveillance Application in Imports number 2017/11 (“Communiqué”) determined procedures and principles for surveillance applications launched into low density polyethylene, which is worth less than certain Unit Customs Values.

The Communiqué was published in Official Gazette number 30135 on 26 July 2017, and entered into effect at the same date.

Qualifying goods can only be imported with a surveillance document issued by the Ministry of Economy (“Ministry”).

To obtain the surveillance document, forms attached to the Communiqué must be completed and sent to the Ministry. Surveillance documents are valid for six months and cannot be transferred. Surveillance documents must be returned to the Ministry within ten business days after expiry.

Application and Distribution Procedures and Principles for Tariff Quotas in Relation to a Safeguard Measure Imposed on Unframed Glass Mirrors From Iran

The Communiqué on Tariff Quotas in Imports number 2017/2 (“Communiqué”) determines procedures and principals for applying and distributing tariff quotas related to the safeguard measure imposed on unframed glass mirrors imports from Iran. The Communiqué was published in Official Gazette number 30135 on 26 July 2017 and entered into effect on the same date.

To apply to receive the tariff quota, an Import License Application Form must be completed and sent to the Ministry of Economy (“Ministry”) with the following documents:

– Signatory circular.

– Power of attorney, if the declarer and importer are different.

– Proforma invoice or commercial invoice.

The tariff quota will be distributed on a first-come, first-served basis. The tariff quota amount granted will not exceed net 25 tones per import license. Quota shall apply for the amounts and periods specified below:

During imports made within the scope of a tariff quota, the customs authority will request import license and documents reflecting the preferential origin of the goods. Import licenses must be returned to the Ministry after expiry and cannot be transferred.

Turkish Financial Incentives Scheme Extended for Investments in Unlicensed Power Generation

The Communiqué on Application of the Decree Regarding Governmental Grants on Investments published in the Official Gazette dated number 28329 on 20 June 2012 has been amended by the Communiqué Amending the Communiqué Regarding Application of the Decree on Governmental Grants on Investments numbered 2017/1 published in the Official Gazette number 30135 on 26 July 2017 .

Accordingly, unlicensed power generation investments are now also included in the table attached to the respective Communiqué (Annex-4) and will be considered within the scope of the those for which incentive certificates can be prepared by the local units.

Additional customs duty has been applied to the products in list number II, attached to the Import Regime Decision by Council of Ministers Decree number 2017/10476 (“Decree”).
