With the Amendment to the Articles of Association of the Central Bank of the Republic of Turkey, Seizure of the Assets Belonging to Foreign Central Banks has been Prohibited

The Presidential Decree numbered 5552 published in Official Gazette dated 13 May 2022 and numbered 31834. The decree amended the Articles of Association of the Central Bank of the Republic of Turkey (“CBRT”), in parallel with the amendment made to the Law of CBRT dated 14 January 1970 and numbered 1211 with law dated 19 January 2022 numbered 7351, have been amended. Thus, seizure of money, receivables, goods, rights and assets belonging to the central banks of foreign countries, and placing of precautionary injunctions and precautionary liens on them were prohibited. Accordingly, when the court and arbitral decisions taken against foreign states are to be enforced and executed in Turkey, it will not be possible to seize the relevant country’s central bank’s assets located in the Central Bank.
