Tariff for the Regulation of Licensed Trustee Warehouses was published on the Official Gazette numbered 32406 and dated 21 December 2023. The tariff determines the fees to be charged for goods kept in licensed trustee warehouses and private warehouses and garages in 2024 and will enter into force as of 1 January 2024.
Tariff for the Regulation of Licensed Trustee Warehouses (“Tariff”) was published on the Official Gazette numbered 32406 and dated 21 December 2023.
The tariff determines the fees to be collected in 2024 for the goods kept in licensed trustee warehouses and private warehouses and garages, and for locksmith, towing and transportation services during storage.
The Tariff includes arrangements for the calculation of the retention fee, the maximum amount of the retention fee, and the receipt of the retention advance.
The remarkable matters within the scope of the Tariff are as follows:
- Pursuant to the Tariff; the storage fees determined for 2023 have been increased.
- It is regulated that the fee to be paid for the storage operations performed in a location until the licensed trustee warehouses become operational in that location shall be calculated over 80% of the storage fees in the fee table, and the fees determined for towing, transportation, porterage and locksmith services in the fee table will not be applied in locations where there is no licensed trustee warehouse.
- Regulations regarding movable goods that are not seized have been regulated as a separate entry with the Tariff, and the storage fee for these goods has been determined as 6.-TL per m3 over the volume/m3 price of the goods for all regions.
- In the calculation of the fee, the day on which the preservation is completed will not be taken into account, the starting date of the preservation fee will be the date of delivery of the goods to the warehouse, the preservation fee of the goods whose preservation is special will be appreciated by the relevant execution office by taking into account the market conditions, and even if the distance between the place where the goods are taken under custody and the warehouse where they will be delivered is greater, the transportation and towing fee will not exceed the amount to be paid for a distance of 50 kilometers.
- While determining the fee to be paid for the towing, transport and porterage services during the storage of the confiscated goods to be delivered to the licensed trustee warehouses, the nature of the work, the duration, the labour and expense spent are taken into consideration, and it is ruled that the execution office will also appreciate the fee below the specified fees for the works performed more easily and in a short time without much labour and expense.
- Pursuant to the Tariff; the custody fee for the non-seized movable properties will be determined by taking the fee schedule into account by the enforcement and bankruptcy offices in other cases requiring eviction, precaution and preservation to the trustee, and this fee cannot be less than the sum of the five-day wage.
- At the end of the preservation period of the non-seized movable properties, the fee to be calculated by the enforcement and bankruptcy offices in other cases requiring eviction, precaution and preservation to the trustee cannot exceed the total of the six-month preservation expenses.
- It is determined that at least three months of preservation expenses of the goods will be taken into account when calculating the preservation advance, and in cases where the preservation advance is not sufficient, the sequestration officer will give the creditor a reasonable time to complete the advance.
