The Personal Data Protection Board (“Board”) issued a decision, dated 6 February 2020, and numbered 2020/93, in response to data-subjects (“Petitioners”) seeking modification or deletion of certain non-current health data, the availability of which was negatively impacting their lives.

Petitioners sought an order of the Board directing that certain of their non-current health data, including mental health data, be modified or deleted. The persistence and availability of the data were negatively impacting their lives. The Ministry of Health (“Ministry”) had already denied an identical request.

The Board found no grounds for granting the relief requested by Petitioners since the data were processed by the Ministry in accordance with article 6 of Personal Data Protection Law numbered 6698.
