The Regulation Amending the Regulation on the Working Procedures and Principles of the Personal Data Protection Board was published in the Official Gazette dated 30 December 2023 and numbered 32415 to amend the articles on the matters to be included in the decisions, the storage of decisions and the formation of specialized commissions or working groups regulated in Regulation on the Working Procedures and Principles of the Personal Data Protection Board. The working procedures and principles, duties, powers, and responsibilities of the Personal Data Protection Board (“Board”) are determined by the Regulation on the Working Procedures and Principles of the Personal Data Protection Board (“Regulation“), which entered into effect after being published in the Official Gazette dated 16 November 2017 and numbered 30242. With the Regulation Amending the Regulation on the Working Procedures and Principles of the Personal Data Protection Board (“Amendment Regulation“), the Regulation in article 13/1(b) about the issues that must be included in the decisions, the requirement to include the “names and surnames of those who conducted the examination and research” and the regulation in article 14/2, which regulates the storage of decisions, “The approved decision samples to be sent to the units do not contain the reasons for dissenting votes” in the Regulation has been repealed. The provision in article 16 of the Regulation stipulating that only members can be in the formation of “specialized commissions or working groups” and that the Board staff can be assigned by the Board’s decision has been updated, and the Amendment Regulation stipulates that specialized commissions or working groups can be established “with the participation of members and/or Authority staff and other relevant parties”.
