The following article gives a summary of decrees by the Council of Ministers and communiqués by the Ministry of Economy regarding the prevention of the unfair competition on imports between 1 May 2018 and 31 May 2018.

Investigation Launched Into the Nullifying Measures on Imports of Hinges, Fixed Hanger, Hat Hangers, Elbows and Similar Goods From Germany and India

Samet Kalıp ve Madeni Eşya San.ve Tic. A.Ş. and Mobilya Aksesuar Sanayicileri Derneği (MAKSDER) requested an investigation to be initiated into the nullification of the measures of the imports on hinges classified under tariff code 8302.10 except those used for civil aircraft and transport means classified under tariff code 8302.10.00.00.12, fixed hanger, hat stand, bracket and similar goods classified under tariff code 8302.50.00.00.00 and others for furniture classified under tariff code 8302.42.00.00.00 from/of Germany and India.

Accordingly, an investigation was initiated by the Communiqué on Unfair Competition Prevention in Imports numbered 2018/17, published in Official Gazette number 30410 on 3 May 2018 (“Communiqué”).

Parties which are sent a notification will be allowed 37 days from the date the notification was sent to respond (including the mailing period). For parties which are not sent a notification (or to whom the notification is not delivered), the 37 day period will run from the date the relevant Communiqué was published.

Inspection Certificates will be Required for Importing Certain Valves

Following the Communiqué on Inspection in Imports numbered 2018/6 published in Official Gazette number 30423 on 16 May 2018, an inspection procedure will now apply for the following goods:

Pursuant to the Communiqué, an inspection certificate will be required to be obtained from Ministry of Economy General Directorate of Imports to import the good noted above.

Anti- Dumping Duty Will Continue for Plywood Imports from China

The Import General Directorate of the Ministry initiated an interim revision investigation into dumping duties which currently apply to Plywood imports from China, classified under tariff code 4412.10, 4412.31, 4412.33, 4412.34 and 4412.39. It decided to continue the existing definitive measures, with certain amendments as below. The measure entered into effect by being published in Official Gazette number 30428 on 22 May 2018.

The anti-dumping duty will therefore continue as follows:

Inspection Certificates will be Required for Importing Certain Transmission Straps and Related Goods

Following the Communiqué on Inspection in Imports numbered 2018/9 published in Official Gazette number 30429 on 23 May 2018, an inspection procedure will now apply for the following good:

Pursuant to the Communiqué, an inspection certificate will be required to be obtained from Ministry of Economy General Directorate of Imports to import the goods noted above.

Expiry Review Investigation Launched into Anti-Dumping Duty on Polyester Stable Fibre Imports from China

With the support of seven companies, Sasa Polyester Sanayi A.Ş. requested the Import General Directorate of the Ministry initiate an expiry revision investigation into imports of polyester stable fibre from China, classified under tariff code 5503.20.00.00.00. The request was made on the grounds that terminating the current anti-dumping duties would lead to continuation and repetition of related damages.

The companies supporting the investigation are:

Anti-Dumping Duty Will Continue for Granite Imports from China

The Import General Directorate of the Ministry initiated an expiry revision investigation into dumping duties which currently apply to granite imports from China, classified under tariff code 6802.23 and 6802.93. It decided to continue the existing definitive measures.
