The Regulation on the Amendment to the Regulation on Licensed Warehousing of Agricultural Products (“Amendment Regulation”) and the Notification on the Granting of Establishment Authorization to Licensed Warehouse Operators (“Notification”) entered into force upon their publication in the Official Gazette dated 11 March 2026 and numbered 33193.
Under the amendments introduced by the Regulation and the Notification, the procedures and principles regarding the application, evaluation, and renewal processes for establishment authorization, branch opening authorization, and capacity increase authorization of licensed agricultural warehouse operators have been regulated. In addition, the collateral obligations of licensed warehouse operators and the criteria to be considered in the evaluation of authorization applications have been determined.
The purpose of the Notification is to determine the procedures and principles governing the application, evaluation, and renewal processes regarding the granting of establishment authorization, branch opening authorization, and establishment capacity increase authorization to licensed agricultural warehouse operators. Within the scope of the Notification, the authorities to which authorization applications will be submitted, the documents required to be submitted during the application process, the criteria to be taken into account in the evaluation of applications, as well as the procedures related to the monitoring and renewal of applications have been determined.
The provisions of the Notification apply to companies seeking to establish licensed warehouse operators and to the application processes concerning branch openings or capacity increase requests of existing licensed warehouse operators. In the evaluation of such applications, it is stipulated that economic need and efficiency criteria shall be assessed independently for each district.
The main regulations introduced by the Notification are as follows:

- It has been stipulated that applications for establishment authorization, branch opening authorization, and establishment capacity increase authorization shall be submitted to the Provincial Directorates of Trade located in the province where the investment is planned.
- It has been regulated that, following the examination of the applications by the Provincial Directorates, the applications shall be submitted to the General Directorate of Domestic Trade for evaluation and that an application tracking order on a district basis shall be established.
- In the evaluation of applications, it has been provided that economic need and efficiency criteria, such as the production volume in the relevant province or district, the existing licensed warehouse capacity and occupancy rates, and the commercial structure of the region, shall be taken into consideration.
- In addition, the Notification introduces limitations on licensed warehouse investments in organized industrial zones and sets forth rules aimed at preventing non-licensed storage activities within licensed warehouse facilities.
Under the Amendment Regulation, it has been regulated that the obligation to provide an increased amount of collateral as stipulated under the Regulation on Licensed Warehousing of Agricultural Products shall not apply to licensed warehouse operators whose total shareholding of 51% or more is held by public institutions and organizations, professional organizations with public institution status and their umbrella organizations, state economic enterprises, or public economic establishments.
