The following article gives a summary of decrees by the Council of Ministers and communiqués by the Ministry of Economy regarding prevention of unfair competition in imports, made between 1 May 2017 and 31 May 2017.
Dumping Investigation Launched into Glass Fibre Reinforcement Materials Imports
Cam Elyaf Sanayii A.Ş. requested quested the Import General Directorate of the Ministry initiate a dumping investigation into “glass fibre reinforcement materials”, imported from Egypt, classified under tariff code number:
- 12.00.00.00
- 19.10.00.00
- 19.90.00.00
- 31.00.00.00
- 90.00.10.00
- 90.00.30.00
Accordingly, an investigation has been initiated by the Communiqué on Unfair Competition Prevention in Imports numbered 2017/11, published in Official Gazette number 30066 on 14 May 2017 (“Communiqué”).
Parties which are sent a notification will be allowed 37 days from the date the notification was sent to respond (including the mailing period). For parties which are not sent a notification (or to whom the notification is not delivered), the 37 day period will run from the date the relevant Communiqué was published.

Anti-Dumping Duty Will Continue For Pentaeritritol (pentaeritrit) Imports
The Import General Directorate of the Ministry initiated an expiry revision investigation into dumping duties which currently apply to pentaeritritol (pentaeritrit) imported from China, classified under tariff code 2905.42.00.00.00. It decided to continue the existing definitive measures, without making any amendments.
The measure entered into effect by being published in Official Gazette number 30066 on 24 May 2017.
The anti-dumping duty will therefore continue as follows:

Procedures and Principles Introduced for Surveillance Applications Regarding Photovoltaic (solar) Module and Panels
The Communiqué on Surveillance Application in Imports number 2017/3 (“Communiqué”) determines procedures and principles for surveillance applications launched into photovoltaic (solar) modules and panels.
The Communiqué entered into effect by being published Official Gazette number 30064 on 12 May 2017.
Qualifying goods can only be imported with a surveillance document issued by the Ministry of Economy (“Ministry”). To obtain the surveillance document, forms attached to the Communiqué must be completed and sent to the Ministry with the following documents:
- Signatory circular.
- Power of attorney, if the declarer and importer are different.
- Proforma invoice or commercial invoice.
Surveillance documents are valid for six months and cannot be transferred. Surveillance documents must be returned to the Ministry within ten business days after expiry.

Expiry Review Investigation Launched into Anti-Dumping Duty on Pipe Connection Parts
Two companies jointly requested the Import General Directorate of the Ministry initiate an expiry revision investigation into imports from Brazil, Bulgaria, China, Indonesia, India and Thailand of “pipe Connection Parts (and others)” classified under tariff code 7307.19. The request was made on the grounds that terminating the current anti-dumping duties would lead to continuation and repetition of related damages.
The compaines requesting the investigation are Trakya Döküm Sanayi ve Ticaret A.Ş. and Konak Rakor Sıhhi Tesisat Malzemeleri İnşaat Turizm Gıda Sanayi ve Ticaret Ltd. Şti..

Expiry Review Investigation Launched into Anti-Dumping Duty on Synthetic Adhesive Fibres from Polyester
Sasa Polyester Sanayi A.Ş. requested the Import General Directorate of the Ministry initiate an expiry revision investigation into imports from Korea and Indonesia of “synthetic adhesive fibers from polyester” classified under tariff code 5503.20.00.00.00. The request was made on the grounds that terminating the current anti-dumping duties would lead to continuation and repetition of related damages.
Accordingly, an investigation was initiated by the Communiqué on Unfair Competition Prevention in Imports numbered 2017/14, published in Official Gazette number 30064 on 12 May 2017.
