The Regulation Amending the Regulation on the Sales of Used Motor Vehicles does not contain any substantive changes and the provisions specified therein are applicable as of December 7, 2023.
The Regulation Amending the Regulation on the Sales of Used Motor Vehicles (“Amendment Regulation“) has been published in the Official Gazette dated 7 December 2023 and numbered 32392. The Amendment Regulation does not introduce any fundamental changes to sales of used motor vehicles and postpones the effective date of provisions which have already been published.
The provisions whose implementation has been postponed to July 1, 2024 with the Amending Regulation are as follows:
- Used vehicle dealers shall not directly or indirectly market or sell vehicles, motorcycles, and off-road vehicles before 1 July 2024 unless 6 months and 6.000 kilometres have passed from the date of first registration This period was extended by 1 year from July 1, 2023, to July 1, 2024. Pursuant to the amendment regulation published in the Official Gazette dated 13.02.2023 and numbered 32398, “motorcycles” are included in this provision.
- The Amendment Regulation also provides that used motor vehicles shall not be marketed through advertisements at a price higher than the manufacturer’s or distributor’s recommended selling price until 1 July 2024. This period was extended by 6 months from January 1, 2024 to July 1, 2024. The Amendment Regulation authorizes the Ministry of Commerce to extend this date by up to 6 months.
