On 13 October 2015, Moroğlu Arseven, K&L Gates LLP and EY Türkiye jointly hosted a conference on “Enforcement Trends & Dispute Resolution Management in the EU, MENA, Turkey, Russia and the CIS for the Construction & Infrastructure Sectors”. The conference was attended by over 120 people, bringing together industry representatives, senior lawyers and consultants from Turkey, the United Kingdom and Dubai, with hands-on experience and insights gained from working in the construction and infrastructure sectors.

The conference agenda was split into four sessions, addressing key legal and commercial aspects of the industry. Industry speakers shared their insights and experiences with attendees, while other sessions involved senior advisors considering legislative and enforcement trends, compliance risks and dispute resolution processes.

During Session 1, representatives from Turkish construction companies shared their insights regarding foreign markets, based on specific recent experiences and observations. Speakers discussed the risks they anticipate across a range of operational matters, along with the approaches and preparations adopted in response to these risks, based on experience gained in the EU, MENA, Turkey and Russia.

Speakers during Session 2 addressed legislative and enforcement trends in the EU, MENA, Turkey and Russia, with a particular focus on compliance issues within the scope of anti-corruption practices. Speakers informed participants about the legal framework and approaches developed in England, Russia, Europe, the Middle East and Turkey in the field of anti-corruption, as well as provided insights into enforcement.

Session 3 saw speakers focus on compliance risk management. The session addressed methods and procedures for risk management as well as key principles on how these procedures should operate. Practical methods of protection and risk mitigation are addressed, including contractual provisions and due diligence, as well as key steps to take when faced with a problem.

The final session of the day saw speakers address arbitration and related dispute resolution considerations. These included pre-arbitral proceedings, proceedings between state and private parties, as well as proceedings between private parties. Speakers outlined a practical and experienced-based road map, plus discuss what parties should expect for enforcement of arbitral awards.
